1. Who Can Use ORCA

ORCA is intended for use by coaches who are 18 years or older and operate, or intend to operate, an independent coaching business. By creating an account, you confirm you meet this requirement.

2. Your Account

• You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate information when creating and maintaining your account.
• Notify us promptly at orcaswimapp@outlook.com if you suspect unauthorized use of your account.

3. Independent Business Relationship

ORCA is a platform/tool that helps you manage your own coaching business. ORCA is not:

• Your employer
• A party to the coaching relationship between you and your clients
• Responsible for the quality, safety, or outcome of lessons you provide

You are solely responsible for your own coaching services, your relationships with your clients, and compliance with any laws or regulations that apply to your coaching business (e.g., certifications, insurance, child safety requirements, local business licensing).

4. Acceptable Use

You agree not to:

• Use ORCA for any unlawful purpose
• Misrepresent your identity, qualifications, or business
• Upload or store information you don't have the right or permission to use (e.g., a client's data without their awareness or consent)
• Attempt to interfere with, disrupt, or gain unauthorized access to the Platform or other users' accounts
• Use ORCA to harass, harm, or endanger any person, especially minors

5. Client & Student Data You Enter

As an independent coach, you control the client and student information you enter into ORCA (e.g., parent/guardian contact details, student names and ages, lesson notes). You're responsible for:

• Having a lawful basis and appropriate consent to collect and store this information
• The accuracy of the information you enter
• Complying with applicable data protection and children's privacy laws in your jurisdiction

6. Payments & Subscriptions

• ORCA may offer paid subscription plans (e.g., Pro, Premium) with features as described on the Platform at the time of purchase.
• Payments for ORCA subscriptions are processed by Stripe, our third-party payment processor.
• Subscriptions renew automatically unless cancelled.
• ORCA does not process payments between you and your clients. ORCA helps you generate invoice and receipt documents to bill your clients; you are responsible for collecting payment directly from your clients through your own arrangements.

7. Third-Party Integrations

ORCA may let you connect third-party services — such as Google Calendar or Microsoft Outlook — to enable certain features. Your use of those integrations is also subject to the third-party provider's own terms. You can disconnect any integration at any time from your account settings.

8. Intellectual Property

ORCA and its original content, features, and functionality are owned by Swim and Splash Community and are protected by applicable intellectual property laws. You retain ownership of the data you enter into ORCA (e.g., your client records, lesson notes).

9. Termination

We may suspend or terminate your access to ORCA if you violate these Terms. You may stop using ORCA and close your account at any time via your account settings or by contacting us at orcaswimapp@outlook.com.

10. Disclaimers

ORCA is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure at all times.

11. Limitation of Liability

To the fullest extent permitted by law, Swim and Splash Community will not be liable for any indirect, incidental, or consequential damages arising from your use of ORCA.

12. Changes to These Terms

We may update these Terms from time to time. We'll update the "Last updated" date above when changes are made. Continued use of ORCA after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Singapore, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
